Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Construction Check In mobile application (the "App") operated by Construction Check In ("we", "us", or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use the App, you must create an account with a valid email address and password. You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized use of your account

3. Acceptable Use

You agree to use the App only for its intended purpose — construction workforce time tracking, daily reporting, and team management. You agree NOT to:

Submit false or misleading clock-in/out records or reports
Upload inappropriate, offensive, or illegal content
Attempt to access other users' data or other companies' information
Reverse engineer, decompile, or attempt to extract the source code of the App
Use the App for any illegal purpose or in violation of any applicable laws
Interfere with or disrupt the App's servers or infrastructure

4. Company Accounts

Company administrators who register a company on the App are responsible for:

Approving or rejecting employee join requests
Managing team members and their roles
Ensuring their company's use of the App complies with applicable labor laws

We are not responsible for employment decisions, wage calculations, or labor law compliance. The App is a tool to assist with time tracking and reporting — it does not replace proper payroll or HR systems.

5. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

6. Intellectual Property

The App, including its design, code, features, and branding, is the intellectual property of Construction Check In. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

Content you create within the App (photos, reports, notes) remains your property. By uploading content, you grant us a limited license to store and display it within the App to your company's authorized users.

7. Account Termination

You may delete your account at any time through the App's Settings screen. Upon deletion, all your personal data will be permanently removed.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the App's services. We will make reasonable efforts to notify you before taking such action.

8. Service Availability

We strive to keep the App available at all times, but we do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

9. Limitation of Liability

To the fullest extent permitted by law:

The App is provided "as is" and "as available" without warranties of any kind, express or implied
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
Our total liability for any claim related to the App shall not exceed the amount you paid us in the 12 months preceding the claim (if applicable)
We are not liable for inaccurate GPS readings, failed notifications, or data loss beyond our reasonable control

10. Indemnification

You agree to indemnify and hold harmless Construction Check In and its operators from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

Informal Resolution: We encourage you to contact us first at kfirsam201@gmail.com to resolve any issues informally
Binding Arbitration: If informal resolution fails, disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association
Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
